Memorial Health and its locations ("Memorial") welcomes you to its on-line health information websites (the “Sites”) and community communications, including Memorial’s mobile applications and text communications (“SMS Communications”). These Terms and Conditions of Use (the "Terms and Conditions") and the Privacy Policy (the "Privacy Policy") set forth below contain important information regarding the use of the Sites and the information contained therein (the "Sites’ Information"), the use of the websites linked to the Sites (the "Linked Sites") and the information contained therein (the "Linked Information"), and the use of SMS Communications and the information contained therein (“SMS Information”). Your use of the Sites and/or SMS Communications means you accept these Terms and Conditions and the Privacy Policy, which may change at any time without notice. You are advised not to use the Sites or SMS Communications unless the Terms and Conditions and the Privacy Policy are acceptable to you.

Memorial provides the Sites and the links to the Linked Sites for informational purposes only, solely as a convenience for the personal use of users of the Sites (the "Users"). The Sites’ Information and the Linked Information (collectively, the "Information") is general in nature, and access to the Sites does not create a physician-patient or any other relationship of any kind. No statement contained in the Sites or the Linked Sites constitutes medical advice, diagnosis, or treatment, nor is it a substitute for professional advice.
The Sites contains information provided by Memorial and third parties. The Linked Sites contain information provided by third parties. The Information may be changed at any time without notice or permission.
Memorial provides the Sites and the links to the Linked Sites as a community service, and reviews periodically the Sites Information for accuracy, completeness and timeliness. However, the Information is provided "as is," without express or implied warranty of any kind, and without any guarantee that it is accurate, complete, timely or error-free. The Sites contain trademarks and service marks owned by Memorial or third parties. Privacy Policy for the Sites and SMS Communications
The Sites and SMS Communications require Users to provide certain personal information in order to use certain features and functions. This information may include a User's name, cellular phone number, address and/or e-mail address (hereinafter referred to as “personal information”). When personal information is combined with any information on your health or medical status, we refer to this information as “medical information” or“health information.” FOR INFORMATION AS TO HOW MEDICAL OR HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED BY MEMORIAL, AS WELL AS HOW YOU CAN GET ACCESS TO THIS INFORMATION, PLEASE CLICK HERE. We also often collect information on use of the Sites that has nothing to do with you as an individual, only as an anonymous User (to hereinafter include users of SMS Communications) of the Sites or SMS Communications. We call this information “aggregate information.” In these cases, researches, business analysts, system designers and others may have access to the data we collect. When you use our Sites or SMS Communications, you automatically allow us to collect personal and aggregate information. Memorial may review, collect and analyze personal or aggregate information; it may share aggregate information with health care professionals; it may share personal information with health care professionals in accordance with Memorial’s Notice of Privacy Practices; it may use personal or aggregate information to contact Users to solicit feedback and suggestions; and, in limited circumstances, it may disclose personal or aggregate information to third parties if required by law.
Memorial values the privacy of Users and recognizes their sensitivity to the disclosure of personally identifiable information. Memorial does not sell User information. However, the Internet and text messaging are not secure. Therefore, Memorial cannot ensure or warrant the security of information provided to or by Memorial or posted on the Sites.
Interactive Services/Tools
Some of the interactive tools on our Sites ask you for personal information and medical or health information. Specifically, our pre-registration tools may ask for information including, but not limited to, your name, Social Security Number, date of birth, address, insurance information, procedure to be performed and diagnoses. The bariatric services tools use the medical or health information you provide to prescreen you for entry into our bariatric services program. The medical or health information you provide is kept confidential and can only be accessed in accordance with Memorial’s Notice of Privacy Practices.
The Sites also may offer services by which Users can communicate with each other, including e-mail capabilities, bulletin boards, chat rooms and/or similar services (the "Services"). Memorial does not control the Services, and is under no obligation to monitor or review their content. Third parties may be able to collect and use personal and other information Users disclose to or post on the Services. Using such information, third parties may engage in unsolicited activities, including attempting to contact Users. Memorial cannot control, is not responsible for, and bears no liability resulting from these activities or any other activities engaged in by third parties accessing information disclosed to or posted on the Services.
Disclaimer of Warranties and Limitation of Liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE SITES, SMS COMMUNICATIONS, APPLICATIONS OR CONTENT THAT YOU RECEIVE FROM MEMORIAL, AND DISCLAIM ANY AND ALL WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE. THE SITES AND SMS COMMUNICATIONS COULD INCLUDE INACCURACIES OR OTHER ERRORS OR MAY NOT FUNCTION IN THE MANNER YOU ANTICIPATED. FURTHERMORE, MEMORIAL IS NOT RESPONSIBLE FOR CIRCUMSTANCES BEYOND ITS CONTROL, INCLUDING, WITHOUT LIMITATION, ACTS OR OMISSIONS OF OTHERS, ATMOSPHERIC CONDITIONS, OR ACTS OF GOD. MEMORIAL DOES NOT PROMISE ERROR-FREE SERVICE.
MEMORIAL WILL NOT BE LIABLE FOR ANY DELAYS IN THE RECEIPT OF ANY SMS MESSAGES AS DELIVERY IS SUBJECT TO THE EFFECTIVE TRANSMISSION FROM YOUR NETWORK OPERATOR. MEMORIAL IS NOT RESPONSIBLE AND WILL NOT BE LIABLE FOR ANY PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL (SUCH AS LOST PROFITS OR LOST BUSINESS OPPORTUNITIES) CLAIM, DEMAND, LOSS, DAMAGE, JUDGMENT OR SETTLEMENT, INCLUDING ATTORNEY’S FEES, ARISING OUT OF, RESULTING FROM, OR ASSOCIATED WITH THE USE OR SUPPORT OF THE SITES OR SMS COMMUNICATIONS, OR BY MEMORIAL’S PERFORMANCE UNDER THESE TERMS AND CONDITIONS AND PRIVACY POLICY, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
Applicable Law
Your use under these Terms and Conditions and the Privacy Policy is governed by the laws of the State of Illinois.
